Terms of service
1. Who we are
Nordblikk provides real estate and short-term rental photography and related services on the French Riviera. These terms apply to every booking made through nordblikk.com. By placing a booking you accept these terms and our privacy policy.
Our full legal identification is set out in the Legal notice.
2. Consumers and business customers
A consumer is a natural person ordering mainly outside their trade or profession. A business customer is anyone ordering for professional purposes, such as an estate agency, a property manager or a conciergerie.
Sections 7 and 10 give consumers rights under the French Code de la consommation. Where any clause conflicts with mandatory consumer law to the consumer's disadvantage, mandatory law prevails. Business customers are bound by all clauses as written, including cancellation fees, notification deadlines and limitations of liability.
3. The service
Photography is creative work. We aim for a consistent, natural-light result, but framing, colour and style are the photographer's professional judgement, and images may look different on different screens.
The result depends significantly on the condition, tidiness and preparation of the property, on the available light and on the weather. Preparing the property is the customer's responsibility.
We may change or withdraw services and prices at any time. Changes do not affect bookings already confirmed.
4. Bookings
A booking is an offer to purchase. The contract is formed when we confirm the booking to you. Please check the date, the address and your contact details before submitting.
You are responsible for ensuring that the photographer has unobstructed access to the property at the agreed time and that the property is ready to be photographed. You confirm that you are entitled to order photography of the property.
If we cannot accept a booking, or if we cancel a confirmed booking and cannot offer a replacement slot, we refund everything paid for that booking.
5. Prices, payment and invoicing
The price is the one displayed at the time of booking and confirmed in your booking confirmation. The price shown is the total price payable; nothing is added afterwards.
Travel supplements depend on the distance from the nearest covered city centre and are shown before you pay. Optional extras are priced separately.
Consumers pay online at the time of booking. Business customers may pay by invoice, with no invoicing fee. Unless agreed otherwise, invoices fall due 14 days from the invoice date. Late payment by a business customer carries statutory late-payment interest plus the fixed recovery indemnity of 40 € provided by article L441-10 of the Code de commerce, without prejudice to reasonable additional recovery costs.
6. Rescheduling and cancellation
A booked shoot can be moved or cancelled free of charge up to 48 hours before the agreed start time.
Later than that, we charge 50% of the agreed price, whether the slot is moved or cancelled outright, because a slot released at short notice cannot usually be resold.
The same 50% applies to a wasted visit: the photographer arrives at the agreed time but the shoot cannot go ahead for a reason attributable to the customer — no access, the property is not ready, or the customer is absent when their presence was agreed.
No fee is charged if the cancellation is on our side or is caused by force majeure under section 12. In that case we agree a new slot with you at no cost.
Notice can be given by email to contact@nordblikk.com or by phone on +33 7 69 07 27 04; it takes effect when we receive it. For consumers, this section applies only to the extent permitted by mandatory consumer law and does not restrict the right of withdrawal in section 7.
7. Consumer right of withdrawal
This section applies to consumers only.
Under article L221-18 of the Code de la consommation you have 14 days from the conclusion of the contract to withdraw from a distance contract without giving a reason. Tell us clearly, by email to contact@nordblikk.com or using the form on the contact page, that you are withdrawing.
If you ask us expressly to begin the service before the 14 days have passed — which is normally the case when the shoot takes place inside that period — then, in accordance with article L221-25:
- if the service has been fully performed before the end of the period at your express request, you lose the right of withdrawal;
- if it has been partly performed, you owe an amount proportionate to what has been provided.
Where withdrawal applies, we refund the sums due within 14 days of being informed.
8. Delivery of the photographs
Retouched photographs are delivered electronically. Delivery times given at booking are estimates and are not guaranteed. We are not liable for delays caused by circumstances beyond our reasonable control, including weather, illness, equipment failure, communication faults, or missing information or preparation on the customer's side.
We keep the delivered files for one month after delivery, after which they may be deleted. Please save them to your own systems promptly; we do not guarantee availability after that period.
9. Image usage rights
The photographer is the author and copyright holder of the photographs.
Your rights. Once the shoot is paid for, you receive a permanent, worldwide, irrevocable and unrestricted licence to use the delivered photographs for any purpose, including commercial use, marketing and sale of the property, publication in any medium, and passing the files on to an estate agent, a client or an advertiser. You may crop, edit and combine the images as needed.
Our rights. We keep the right to use the photographs in our own portfolio, website, social media, printed material and advertising, without additional payment and without time limit.
These rights run in parallel: neither party's use restricts the other's. If you have a specific reason to limit our marketing use — privacy or security, for example — tell us in writing before the shoot or promptly afterwards, and we will accommodate reasonable requests.
You confirm that you are entitled to order the shoot and to grant these rights, and that the agreed use does not infringe anyone else's rights.
10. Complaints
The service is defective if it does not correspond to what was agreed or to what you could reasonably expect.
Tell us within a reasonable time of noticing a defect. A consumer's notice is always in time if given within two months; this does not shorten the statutory guarantees of conformity and against hidden defects, which apply in full. A business customer must complain in writing within seven days of delivery.
Send complaints to contact@nordblikk.com, identifying what is wrong and, where possible, which images are affected. Where a complaint is justified we will re-edit or, if that is not reasonable, reshoot or refund in proportion to the defect.
11. Liability
We are liable for damage we cause by breaching these terms. For business customers, our total liability for any booking is limited to the price paid for that booking, and we are not liable for indirect or consequential loss such as lost profit, a lost sale or lost rental income.
Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or under mandatory consumer law.
12. Force majeure
Neither party is liable for failure caused by an event beyond its reasonable control, including severe weather, illness, accident, strike, power or network failure, or a decision of a public authority. We will agree a new slot at no cost.
13. Personal data
We process personal data in accordance with the GDPR and our privacy policy, which explains what we collect, why, how long we keep it and how to exercise your rights.
14. Applicable law and disputes
These terms are governed by French law. A consumer resident in another EU country also keeps the protection of the mandatory rules of their country of residence.
Before going to court, please contact us so we can try to resolve the matter directly.
15. Changes to these terms
We may update these terms. The version in force is the one published on this page when your booking is confirmed.
